In the most recent cingular bill there is a notice that SMS rates are going up to .15 a message.
Like i said in my post on getting out of cellular contracts the best way to get out is when the carrier’s raise their rates like in this case.
Page 6(page 8 of the pdf) of the terms and conditions of having Cingular service state the following,
“IF WE INCREASE THE PRICE OF ANY OF THE SERVICES TO WHICH YOU SUBSCRIBE, BEYOND THE LIMITS SET FORTH IN YOUR RATE PLAN BROCHURE, OR IF WE MATERIALLY DECREASE THE GEOGRAPHICAL AREA IN WHICH YOUR AIRTIME RATE APPLIES (OTHER THAN A TEMPORARY DECREASE FOR REPAIRS OR MAINTENANCE), WE WILL DISCLOSE THE CHANGE AT LEAST ONE BILLING CYCLE IN ADVANCE (EITHER THROUGH A NOTICE WITH YOUR BILL, A TEXT MESSAGE TO YOUR EQUIPMENT, OR OTHERWISE) AND YOU MAY TERMINATE THIS AGREEMENT WITHOUT PAYING AN EARLY TERMINATION FEE OR RETURNING OR PAYING FOR ANY PROMOTIONAL ITEMS, PROVIDED YOUR NOTICE OF TERMINATION IS DELIVERED TO US WITHIN THIRTY (30) DAYS AFTER THE FIRST BILL REFLECTING THE CHANGE.”

Just call up Cingular and explain why you want out for free.
If they want to see their own terms pdf, instruct them to go to cingular.com>personal plans>support and on the right is a link for the terms and conditions.
Want to port your number out?
It’s slightly more complicated, but just ask them to notate your account to waive your cancellation and then port it out to another carrier

i tried it and it didnt work, the lady was stubborn that the sms is a pay per use and therefore its not a breach of contract

The language that cingular uses is very clear,
“IF WE INCREASE THE PRICE OF ANY OF THE SERVICES…YOU MAY TERMINATE THIS AGREEMENT WITHOUT PAYING AN EARLY TERMINATION FEE”
Just keep on trying and you will succeed!
but i didnt actually subscribe for the sms, i use it as a pay-per-use
When you signed up for service you automatically subscribed for .10 pay per use SMS.
They are breaching their contract by raising that to .15, and therefore they must waive the ETF.
If after a couple of calls you are’nt successful, try contacting your state attorney general or the BBB.

Wadda ya mean, notate? its either they cancel it on the spot or not?>
They have the ability to either change your ETF to 0 upon cancellation, or to make a note that they are waiving the ETF.
Finding a rep to do that for you may be a challenge.
how about having sprint cancel the plan and then calling cingular and tell them the reason… they voided their contract etc.
sprint will then port your number from there. should work no?
What if you alreasy cancelled a month ago? and agreed to the early termanation fee?

30 days from when you get the bill notifying you of the change.
I tried on the phone they wouldn’t let me out they keep saying that they’re legal team says it isn’t part of the contract because if I don’t use text Mess. then there is no charge anyway I kept beating on them till they gave me 3 months free text on 3 of the lines of my 5 line family plan do we have anybody that got out of the contract that can share details
