Update 6/20/24: Many commenters are confused about what Chapter 11 Bankruptcy is.
Chapter 7 is a liquidation bankruptcy which means it doesn’t require a repayment plan but the business has to sell some assets to pay creditors. In this case Gift Cards would become null. That is not what Patis is doing.
Chapter 11 is a reorganization bankruptcy that allows businesses to maintain their operations while creating a plan to repay creditors.
In this case, Patis is utilizing Chapter 11, in an effort to to keep their stores open and honor all gift cards.
Update 6/19/24: Patis’ parent company is in the process of going through Chapter 11 Bankruptcy filings with the courts in New Jersey.
That can be an indicator that Gift Cards may lose their value at some point in the future.
Patis is planning to keep most stores open. Hopefully with this restructuring they will be able to stay open for years to come, as they offer an excellent product that no one else does.

Seems to me that they are ok with you buying many, and that’s actually their goal.. to raise money… just to get you the feeling that its limited, they write the limit.. so you feel you got a bargain by buying many.

With the Chanukah one, their stated goal (in the comments) was to get people to buy them to try them out and become regular customers. I assume that’s the same goal here.

I have to assume they’d honor the gift cards. Having a big sale on gift cards and then declaring bankruptcy less than a year later so you don’t need to honor those gift cards would be blatant geneivah.
I am a business owner and things drastically fluctuate year to year. The food business has very low margins and even a small percent increase in prices or slower business could lead to big losses
They also have been opening new stores recently which I don’t think they would be doing if planning bankruptcy shortly after
You should give the benefit of the doubt and I say that as someone who bought the gift card and don’t want to lose the rest of my money still on the card
I don’t either think this was intentional, but I do believe that these exorbitant discounts may have led to the bankruptcy.
As you point out, the food service business has very low margins, and if people treat your loss leader as a one and done it is just a loss without leading to any increase.
There is also the issue of the speed at which they have been scaling the business which isn’t usually healthy.
Let’s hope the the restructuring won’t be too damaging and they come out stronger for it.
And for anyone still holding these gift cards, you are on notice, go spend them while your are certain they have value.
They are letting the public know to use them now to avoid this issue in the event the bankruptcy courts voids them.

I see every indication of a group of (likely young) ambitious businessmen putting up a great effort and making it ninety percent.
I would imagine the half off gift cards was a means to increase liquidity and was rationalized as a loss leader.

Over 70 percent of gift cards from that sale have been redeemed already. Yes it was a mistake to offer them. Geneivah is a strong word here. Especially since our plan is to continue to honor gift cards. Creating a false sense of panic and people spreading rumors or making believe they know what is going on can be harmful. We ask everyone to be mindful to that.
I never said they weren’t going to honor the gift cards. The post made it sound like that was a possibility and I was just noting that it would be blatant stealing if they didn’t. Plenty of companies go through bankruptcy and end up not honoring gift cards but this would be the first company I’ve ever heard of that had a major sale on gift cards (50% off) and then declare bankruptcy within a year of that sale (which would be a scam). If they honor the gift cards, then no harm, no foul.
Until when should we try to use them?
My wife was actually in the store today and wanted to buy gift cards as a year end gift for the teachers and they told her they aren’t selling them anymore. Wonder if that has anything to do with this news.

Gift cards have been honored continuously. While its possible there was a system issue in that store, all gift cards have been honored.
Patis, apparently not if customers are being refused using the cards. My $0.05 of business advice is to try to get contact info of customers who had their gift cards refused and work out an arrangement to make sure they have a smooth experience the next time they are in the shop.
The past 4 times I tried using the gift cards in the Crown Heights location they said the system for them is down so I needed to pay full price.
A few weeks ago I tried giving my phone number and they wanted the actual giftcard number. said they were moving to a new computer system.
Today I went and no problem using my phone number to look up gift cards.

I’ve done a quick review of the bankruptcy docket (this should not be considered legal advice and if you have a legal question please consult with competent counsel). The case filed in NJ on May 29th. The immediate cause of the filing was to avoid an eviction at one of their locations. The filing is under subchapter V of Chapter 11 which is a special section for small business reorganizations (this type of filing is indicative that the business is trying to reorganize and not liquidate). The three month budget did not look pretty and the business is projected to just make a profit before considering bankruptcy expenses (note that rabbinical supervision is less than 1% of their monthly expenses so don’t blame that for the filing). As of the filing date the company had 21,000 gift cards with an aggregate balance of $851,000. The Bankruptcy Court entered an order allowing the gift cards to be honored in the ordinary course so as Elan alluded to you should be able to use the gift cards (but these things can change very quickly). The owner of the business is in the process of selling most of his equity with the proceeds going into the company to allow it to continue to operate (while equity typically gets wiped out in bankruptcy this new Subchapter V has different rules and equity can be maintained after 3-5 years of payments on old debt). This is not what someone acting in bad faith would do and is indicative that the owner is really trying hard to make this business work. These are all public facts gleaned from the bankruptcy docket.

wow that thousands of gift card holders, Imo i don’t see how they get wiped out in any scenario short of the business closing – the public outcry would be too great.

Also, a few people have been saying they can’t use the gift cards. What do you do if they don’t want to accept GC in-store?

Dan, a question : I purchased quite a few of these Gift Cards when the special ran but I have not used them yet. Because of your PSA, I want to use ASAP. My problem : I remember receiving an image to scan when I go to a store to use my coupons but I’m a Bubbie and now I can’t locate that image !
